INTRODUCTION – A request for redress for scoring an unfair race.
PROCEDURAL MATTERS – The hearings for # 1,2,3 and 4 were heard together. The protest time limit for all cases was extended due to conditions beyond the parties’ control.
FACTS FOUND
1) Race 2 was held in light and shifty winds – wind speed 4 knots and dropping, wind shifts of 40 – 50 degrees.
2) All boats finished and were scored
3) The race committee did not abandon.
4) The race committee declared that the race was unfair.
CONCLUSIONS AND RULES – The race committee made an improper action by not abandoning the race in accordance with RRS 31.2(d). The conditions for redress under Rule 62.1(a) have been met. Applicable rules: RRS 32.1(d); RRS 62.1(a); RRS 64.3
DECISION: Redress is granted. Race 2 is abandoned.
