Gwhiz in Spin2 sailing East, upwind on Starboard, closehauled on it layline for windward mark 3 in W/L Course 3 June 14 race about 1/4 mi from Mark 3. Tenacity in Spin3 sailing West, having rounded Mark 3, is sailing on the same line, on Port with spin up and back through the rest of the beercan fleet most still headed her direction toward the windward mark. Gwhiz hails "starboard" several times beginning 4 boat lengths as boats converge. Gwhiz bears away slightly to try to avoid Tenacity who does not appear to be checking the course. At the last minute, as Gwhiz bears away and continues to hail, Tenacity slightly bears away (toward Gwhiz) then bears up and away-swinging her starboard aft quarter against Gwhiz's starboard bow. Significant collision, Tenacity crew relaxed in cockpit, no looking. Damage to Gwhiz starboard bow; and Tenacity left her rear quarter stanchion, lifelines and music speaker tangled in Gwhiz's bow. Gwhiz, ahead in spin 2 fleet, recovers and continues sailing but now at back of pack. |

While on the down wind leg between mark 8 and 6 in winds of 15-18knts out of the North we were sailing on a starboard tack with heading of about 190 and Serenity was approaching on Port tack headed to mark 6. Upon recognizing that we were on a collision course I called from the bow "Starboard" to the offending vessel which was acknowledged with the eye contact and a verbal response from Serenity of "OK". There was no immediate action to prevent collision by the helm on Serenity so another call of "Starboard" was made from the bow of White River. That call, even though we were closer, and call was made louder was ignored by Serenity, creating an imminent collision (which would have resulted in our bow slamming into Serenity's aft quarter) at which point We headed up to the wind and took Serenity's stern by less than 20 feet to avoid collision.
I immediately called to Serenity that he was under protest and notified the race committee over the VHF channel 69 of the protest intentions which was acknowledge by race committee. The Red protest flag was immediately displayed. For good measure Serenity was once again notified after the race at approximately 20:50 while under auxiliary power just inside the inner harbor break wall heading North in the fairway, after our attempt at a discussion and resolution was ignored, that I was indeed intending to move forward with protest hearing and he was in fact under protest for the Rule 10 Foul. |
